R.M.Williams Christmas Competition 2022 Terms & Conditions
1. TERMS: These terms and conditions comprise of Part 1 which sets out important information about the promotion and Part 2 which sets out details of the prize. Parts 1 and 2 are collectively referred to as the “Conditions”. By participating in the promotion entrants agree to be bound by the Conditions. Entries must comply with the Conditions to be valid.
2. ENTRY ELIGIBILITY:
(a) R.M.Williams Christmas Competition
Entry is open to registered members of R.M.Williams and South Australian Tourism Commission customer databases, who make a purchase of an R.M.Williams product in Australia in store or online or at a participating stockist store and fill out the entry form during the promotional period and provide their personal details and subscribe to the customer database (email address) at the time of purchase.
3. NOTES ON ENTRY ELIGIBILITY
(a) Purchases – R.M.Williams Members
Registered members of R.M.Williams who make a purchase of an R.M.Williams product in Australia in store or online or at a registered stockist store and fill out the entry form during the Promotional Period and become a South Australian Tourism Commission member will be automatically entered into the draw if their purchases are paid for in full before the promotion closes.
(b) Number of entries
Entrants receive one (1) entry per transaction
(c) Proof of Purchase
Entrants must retain their original receipt as proof of a valid purchase during the Promotional Period.
(d) Non-eligibility
A member that does not make a purchase during the Promotional Period is not eligible to enter.
4. EXCLUSIONS: in addition to any exclusions set out in the “Entry Eligibility”, employees of the Promoter, its related bodies corporate and any store trading under the “R.M.Williams” brand are not eligible to enter. Immediate family members of any employee mentioned in the previous sentence are also not eligible to enter.
5. PROMOTIONAL PERIOD: the promotion commences at 00.01am (AEST) on Monday 21 November 2022 and closes at 11.59pm (AEST) on Sunday 18 December 2022.
6. LOCATION OF DRAW: The Promotion is a game of chance. The prize draw will take place at R.M.Williams, Level 9, 55 Market St Sydney 2000 on Tuesday 20 December 2022 at 2.00pm (AEST). Each valid entry will be entered into a process of random selection. The winning entries will be the entries that are selected at a random draw.
7. NOTIFICATION OF DRAW RESULTS: The results of the draw will be published on the R.M.Williams website on Thursday 22 December 2022 at 11.00am (AEST). All eligible prize winners will be notified by email. Prize winner(s) are to be notified in writing within 7 days of the draw
8. PRIZES: the national total prize pool is valued at $9,900. Not one prize will be valued at over $9,900 and the total prize pool will not exceed $9,900. The Promoter accepts no responsibility for any variation in the prize values. All taxes (excluding GST) which may be payable as a consequence of receiving a prize is the sole responsibility of the winner. The Promoter shall not be liable for any loss, damage or injury suffered (even if caused by negligence) as a result of accepting and/or using a prize, except for any liability which cannot be excluded by law.
9. FLIGHTS
(a) R.M. Williams will provide Qantas with the contact details of the winners so that Qantas can contact winners to book their prize flights. Before booking, winners must ensure they check the latest Government travel requirements.
(b) The prize winner must book with Qantas for travel before 30 June 2023. Prize travel is subject to availability at the time of booking and the prize cannot be redeemed for cash or other goods or services. The route of prize travel cannot be amended.
(c) The winner and their companion must travel together on all prize travel and will not accrue Qantas Points on any element of the prize. An upgrade cannot be purchased on airfares with cash or Qantas Points.
(d) Prize travel includes GST and taxes included in the price of the ticket. Unless otherwise stated, the prize does not include travel insurance, passports, visas, meals, taxes not included in the price of the ticket, ground transportation, flights, accommodation or any other costs of a personal nature. Compliance with any health or other government requirements is the responsibility of each prize-winner and their companion. The Promoter and Qantas make no representation as to the safety, conditions or other issues that may exist at any destination. Prize travel is subject to Qantas’ General Conditions of Carriage. Qantas Red E-deal Fare Rules apply.
(e) The winners and their companion must travel together on all prize travel and will not accrue Qantas Points on any element of the prize. An upgrade cannot be purchased on airfares with cash or Qantas Points.
(f) The winner and their companion will be booked on a return flight to Adelaide departing from the closest airport serviced by Qantas. Transportation to take the flight will not form any part of the prize.
(g) There can be no changes to travel arrangements once tickets have been issued, or accommodation bookings once the reservation is confirmed.
10. TRANSFERABILITY OF PRIZES: all prizes are not transferable or exchangeable and cannot be taken as cash.
11. UNAVAILABILITY OF PRIZES: in the event that any prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may, but is not obliged to, substitute a prize of equal or greater value, subject to any written directions from the various lottery authorities.
12. UNCLAIMED PRIZES & SECOND CHANCE DRAW: Second chance draw will occur three months after the first draw. Prizes must be claimed by winners before Friday 17 March 2023. All prizes unclaimed as at 11.59pm (AEST) on Friday 17 March 2023 will be entered into a second chance draw which will be held on Tuesday 21 March 2023 at the same time and place as the first draw. The results of the second chance draw will be notified to winners and published on Wednesday 22 March 2023 in the same manner as the first draw.
13. DECISIONS ARE FINAL: The Promoter’s determination regarding the draw is final and binding on all entrants. No correspondence will be entered into between the Promoter and entrants. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if illegitimate, forged, manipulated or tampered with in any way.
14. MINORS: If a winner is under 18 years of age, the prize will be awarded on their behalf to a parent or guardian.
15. VERIFICATION: The Promoter reserves the right to request verification of identity and residential address of winners and any other information relevant to entry into or participation in this promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who is involved in any way in interfering or tampering with the conduct of this promotion.
16. RELEASE: Before the prize is awarded, the winner and any other person(s) sharing the prize with the winner may be required to sign an agreement to release the Promoter from and indemnify the Promoter against any liability arising from the use or participation in the prize. Irrespective of whether an entrant signs a release, by entering in the Promotion each entrant is deemed to release the Promoter from and indemnify the Promoter against any liability, loss, cost, damage, claim, demand, proceeding or litigation of any kind relating to the use or participation in the prize.
17. PROMOTION: Entrants consent to the Promoter using their name, likeness, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
18. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.
19. PRIVACY: Information collected from entrants will be used in accordance with the terms of the Promoter’s Privacy Policy which can be viewed at https://www.rmwilliams.com.au/footer-privacy-policy/Footer-privacy-Policy.html?lang=en_AU Information collected as part of the promotion will be used for the purpose of conducting this promotion (which may include disclosure to third parties, including local lottery authorities, for the purpose of processing and conducting the promotion) and for promotional purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant.
